1. Terms and Conditions

1. This competition is conducted by Peterpans (“the Promoter”).
2. Information on entry, prizes, and procedures forms part of these Terms and Conditions. Entry into the competition constitutes acceptance of these Terms and Conditions.
3. This is a non-acquisitive competition. All communications, including any emails sent post-entry, are subject to these Terms and Conditions.
4. The Promoter reserves the right to amend, cancel, or suspend the competition at any time. Any individual tampering with the entry process or breaching these Terms may be disqualified.
5. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram, TikTok, or Meta Platforms.

2. Who Can Enter?

1. The competition is open to individuals who:
   • Hold a valid Instagram account
   • Are over 18 years of age
2. Employees, agents, or representatives of the Promoter (or their immediate families) are not eligible.

3. How to Enter

1. Entries will be accepted between the 31st July and 16th August at midnight from the official Instagram posts (AEST).
2. Platform-Specific Complete Entry Requirements: To be eligible, all required steps must be completed on a single platform:
   • For Instagram:
     • follow @peterpanstravel
     • like the relevant post
     • tag 1x person who needs to travel the Aussie East Coast (each tag = 1x entry)
     • extra entries (repost x1 entry, share to story and tag us 1x entry)
3. Only entries that fully comply with these instructions on a given platform will be considered valid. The Promoter reserves the right to determine the validity of each entry at its sole discretion.
4. Additional Platform Details:
   • Platform Limitations & Compliance: Participants must adhere to both these competition rules and the respective platform guidelines. The Promoter is not responsible for any discrepancies due to technical issues or platform-specific policies.
   • Verification Process: All entries will be verified. Only entries that fully meet the outlined requirements (including having a public profile for bonus entries) will be deemed valid.

4. Submission Guidelines

1. Each entry must be submitted via a genuine, personal Instagram account.
2. Fake, spam, or robot accounts are strictly prohibited and will result in disqualification.
3. All information provided must be accurate and true.
4. The Promoter reserves the right to disqualify any entry that breaches these Terms or is otherwise inappropriate.

5. Deliberation

1. Winner(s) will be chosen on the date specified in the official posts (AEST), which is Wednesday 19th August 2026 (AEST). The Promoter reserves the complete discretion to select the winner(s).
2. There will be no correspondence between entrants and the Promoter regarding the selection process.
3. All decisions made by the Promoter are final.

6. Prizes

1. The winner will receive the prize as outlined in the official post: 1 FOC space on the Peterpans Group Tour (no add-ons included)
2. Choose to redeem your space on any Peterpans Group Tour departing in October, November, or December 2026
3. Prizes are not transferable or exchangeable and cannot be taken as cash.
4. Peterpans reserves the right to select the operators and specific tour details within this package according to availability, at its sole discretion.
5. The prize is exclusively for the winner and any selected guest(s); tours are not transferable.
6. All prizes, tours, and stays are subject to supplier terms and conditions, which operate separately from Peterpans. Winners are responsible for reading and understanding these conditions.
7. The winner will be contacted within a reasonable time after the competition closes, via a direct message from the official Instagram account. Peterpans is not responsible for any losses due to communication issues or scammers.
8. Peterpans is not responsible if the winner is unable to claim their prize due to lack of access to their account or any other reason; in such cases, the prize is forfeited.
9. The winner is responsible for providing correct and complete details for their tickets.
10. All decisions regarding prize experiences by the Promoter are final.
11. Any prize recipient found by the Promoter to have breached these Terms must return the awarded prize within 30 days of a request, with the Promoter having the final say on its disposition.
12. The Promoter is not responsible for any costs associated with winning or the delivery of prizes unless otherwise stated.
13. With the exception of cash prizes, prizes are not transferable or exchangeable; vouchers must be fulfilled under the providers’ terms, and prizes will be sent to the winner’s nominated address (Australia only).
14. The Promoter is not responsible for any additional or lost costs related to the tours, including (but not limited to) flights, extra transport, travel insurance, lost/damaged luggage, accommodation, medical expenses, food, and drinks.
15. The Promoter strongly recommends that the winner obtains travel insurance for the duration of their trip; the Promoter is not responsible for any losses due to cancellations or weather events.
16. Participants are advised to be cautious of fake profiles. The official Instagram account (@peterpanstravel) is the only channel from which the winner will be contacted. The Promoter will not contact winners via email until confirmed through Instagram. Beware of fake emails.

7. Rights

1. The Promoter reserves the right to display, use, remove, or distribute participant reviews and content indefinitely at its complete discretion.
2. The Promoter may use participant reviews as marketing material on websites, social media, and affiliated platforms.
3. Participants must be willing to share, capture, and film footage of their trip with Peterpans. If the winner is unwilling or unable to provide such content, they may be disqualified.
4. By entering, entrants grant the Promoter the right to use credited images and text (via the Promoter’s website, newsletter, and social media) to promote Peterpans and its initiatives, both online and offline, without further compensation.
5. The Promoter will not be liable for any third-party misuse of reviews or participant content.
6. Each entrant acknowledges that the Promoter is under no obligation to use their entry.
7. Should the Promoter cancel the competition at any point, it holds no responsibility to existing entrants.

8. Website Use

1. You must not use any content from the Peterpans website to distribute, reproduce, publish, alter, modify, create derivative works, or otherwise exploit such content for commercial benefit.
2. You may not transmit unsolicited or unauthorised advertising, collect personal information from the website about others, or upload personal information of others (including names, addresses, phone numbers, or other identifiers).
3. While the Promoter endeavors to maintain continuous website integrity, disruptions or technical difficulties may occur. The Promoter is not liable for any loss or cost incurred due to such disruptions or technical errors.
4. The Promoter is not responsible for any theft, unauthorised access, or distribution of entries.

9. Privacy Collection Statement

1. By submitting an entry, you consent to receive promotional and marketing messages from the Promoter (including electronically sent messages for an unlimited period). You may opt-out at any time by following the instructions in each message.
2. The Promoter and its related entities collect personal information for the purposes of conducting and promoting this competition (including determining and notifying winners). Such information may be disclosed to an agent engaged for prize fulfilment and, if required, to Australian regulatory authorities.

10. Liability and Governing Law

1. Except for liabilities that cannot be legally excluded, the Promoter (including its officers, employees, and agents) is not responsible for any personal injury or any loss/damage (including loss of opportunity) arising from:
   • Technical difficulties or equipment malfunctions (whether or not under the Promoter’s control);
   • Theft, unauthorised access, or third-party interference;
   • Late, lost, altered, damaged, or misdirected entries or prize claims (whether or not after receipt by the Promoter) due to reasons beyond the Promoter’s reasonable control;
   • Any tax liability incurred by a winner or entrant.
2. To the maximum extent permitted by law, the Promoter expressly disclaims liability for any loss or damage (including indirect or consequential losses) or for any personal injury suffered or sustained in connection with your participation in the competition or the acceptance of prizes. Winners indemnify the Promoter against any such liability arising from their actions or omissions.
3. Prize-winners are advised that tax implications may arise from prize winnings and should seek independent financial advice before accepting the prize.
4. This competition is governed by the laws of Queensland, Australia. Each entrant irrevocably agrees that the courts of Queensland have exclusive jurisdiction to hear and decide any disputes arising out of or in connection with the competition.

11. Miscellaneous

1. The Promoter reserves the right to request further information from any entrant to verify identity or eligibility.
2. Failure to comply with these Terms may result in disqualification and forfeiture of any awarded prizes.
